Terms and Conditions (GTC 
(as of August 2022)

 

§1 Scope and provider

(1) These general terms and conditions (hereinafter referred to as GTC) are the basis for business transactions with our guests. They apply to all contractual agreements between MM Homes GmbH - My Baltic Sea (hereinafter provider) and their clients (hereinafter tenant) until new general terms and conditions come into force.

 

(2) Deviating terms and conditions of the tenant will be rejected.

Please read these conditions carefully before making any booking and using any service.

§2 Conclusion of the contract, deposit and right of withdrawal

(1) Contracts on this portal can only be concluded in German and English.

(2) MM Homes GmbH acts as an intermediary between the respective owner of the apartment and the tenant and concludes the rental agreement in the name and for the account of the respective owner. MM Homes GmbH is authorized to make and receive all declarations related to the conclusion and processing of the rental agreement and to assert claims arising from the rental agreement.

 

(3) The tenant must have reached the age of 18.

(4) The rental contract for a holiday property comes about through the booking (offer) by the tenant - regardless of whether this is made in person, by telephone, by fax, by e-mail or via our website etc. - and the sending of the booking confirmation (acceptance) to MM Homes GmbH.

(5) The due date of the amount for the agreed rent is determined with the booking confirmation. The full amount is due within 10 days of the conclusion of the contract. In the event of late payment, the landlord has the right to withdraw from the rental agreement. Guarantee conditions: Prepayment for the entire stay is required.

(6) MM Homes GmbH is obliged to report every guest to the tourism service and to collect the resort tax in advance.

§3 minimum rental period
(1) The minimum length of stay depend on different seasons and holidays. Deviating requests are technically possible, but the landlord is free to refuse them.

§4 Liability

(1) The tenant will be provided with a cleaned apartment in a clean and orderly condition and fully equipped. Any damage, uncleanliness or missing inventory must be reported to MM Homes GmbH immediately after moving in. The tenant must treat the apartment, including the inventory in it, with care and protect it from damage. Damage occurring during the rental period is the responsibility of the tenant and must be reported immediately to MM Homes GmbH.

(2) MM Homes GmbH and the owner are only liable for damages insofar as they are based on a breach of an essential contractual obligation or on their own intentional or grossly negligent behavior or on the part of legal representatives or vicarious agents. If an essential contractual obligation is violated through slight negligence, the liability of MM Homes GmbH and/or the landlord is limited to the foreseeable damage typical of the contract. An essential contractual obligation exists in the case of obligations whose fulfillment makes the proper execution of the contract possible in the first place or on the observance of which the tenant relies and was entitled to rely. Any further liability of MM Homes GmbH and/or the landlord for damages is excluded. Liability for culpable injury to life, limb or health under the statutory provisions remains unaffected. The no-fault guarantee liability of the landlord for initial defects according to § 536a paragraph 1 alternative 1 BGB is excluded, unless it is an injury to life, limb or health.

(3) We assume no liability for the loss or theft of valuables, bicycles or similar.

§5 Additional Services

(1) Pets are very welcome in some of our apartments. The fee of €40.00 includes cleaning, a dog bed and two bowls. The dog rules must be observed.

(2) If available, a cot and a high chair will be provided for a fee of €15,00.

 

(3) The linen package is provided to the tenant (bed linen, hand and bath towels, shower mat and tea towels. A bathrobe can be borrowed for a fee. Sauna towels must be brought along if desired.

 

(4) WLAN is provided by the landlord. However, MM Homes GmbH and the landlord assume no liability whatsoever for the functionality of the Internet or damage resulting from use, in particular virus attacks. Any improper use of the Internet / WLAN, in particular the use of illegal content from the Internet, for example the illegal use of copyrighted content, is prohibited. The tenant indemnifies the landlord and MM Homes GmbH from third-party claims against the landlord or MM Homes GmbH resulting from improper use.

(5) Additional services already booked will not be refunded if they are not used.

§6 arrival and departure, access code, parking space, e-charging station

(1) On the day of arrival, the apartment is available to the tenant from 3:00 p.m. The apartment must be vacated by 10:00 a.m. on the last day. In the event of a late eviction, the owner and MM Homes GmbH each reserve the right to assert additional daily rents and claims for damages. The apartment is to be left in the following condition: - swept clean - rubbish bin emptied - dishes washed - refrigerator emptied - all windows and doors closed - take returnable bottles with you. If these requirements are not met, MM Homes GmbH is entitled to charge the tenant for the associated expenses.

(2) After full payment, the tenant will receive a six-digit access code a few days before arrival, which is valid for the shed, the front door and the apartment door. Any questions about the access code must be clarified during business hours.

(3) One allocated parking space is available free of charge per apartment.

(4) The e-charging station at the parking lot can be booked during your stay. Further information: info@mybalticsea.de.

§7 Withdrawal from the contract, cancellation

(1) If the apartment is destroyed by fire, storm or a similar event or damaged in such a way that it is not habitable, the landlord is entitled to either offer the tenant an equivalent rental property or to withdraw from the rental contract or to terminate it without notice.

(2) The tenant is not released from the early booking rate from paying the rent if the tenant has a personal reason, e.g. B. illness, prevention for professional or family reasons, cannot use the apartment (if cancellation is not free of charge). At this rate, free cancellation of the reservation is not possible. In case of no-show, 100% of the total price will be charged.

(3) A free cancellation of the reservation is possible up to 14 days before arrival at the booked standard rate. In the event of later cancellation after 14 days, the My Baltic Sea holiday apartment rental reserves the right to deduct 80% of the overnight price from the total sum if the reservation is not rented out.

§9 Miscellaneous 
Subsidiary agreements, changes or additions to the rental agreement, including these conditions, should be made in writing for reasons of proof. Should one or more provisions of this contract be or become invalid, the rest of the contract shall remain valid. The statutory provisions shall take the place of the ineffective provisions.
